Nicole Recants… Settlelment Reached?

The highly controversial rape case that supposedly shook the foundations of our good relationship with the United States is now heading to a close. The rape victim, Nicole, who once said that she wanted the death penalty for the suspect and that she was really telling the truth, has recanted her entire story. She now claims that she’s not sure anymore if Lt. Daniel Smith actually raped her and that she “might” have actually consented. I don’t know how you guys will react to this but I definitely think that she was put under pressure and eventually folded and accepted a settlement offer.

Let me quote from an article about Nicole’s thoughts before the hearing of the case started:

MANILA, Philippines—Back then, “Nicole” said that if she had her way, she would like her purported rapists to face the death penalty.

In an interview days before the accused US servicemen were to hear the verdict of the court, Nicole said she was raped and dumped on the pavement.

“If I was not telling the truth, why would I put myself through this situation?” she said, adding that she was proud she had pursued the case, and that she hoped her trial would embolden other rape victims.

She also said she was looking forward to putting the case behind her and moving on with her life, perhaps overseas.

And this is her official statement now:

“My conscience continues to bother me realizing that I may have in fact been so friendly and intimate with Daniel Smith at the Neptune Club that he was led to believe that I was amenable to having sex or that we simply just got carried away,” she said.

It’s a complete 180 degree turnaround, and there are only a few things in this world that can make that happen. One of the strongest forces would be money. Rumors are now circulating that Nicole was paid a large amount of money including her transfer to the US as payment for her new story.

Who would pay her? Well, it could either be Lt. Smith, the American government, or maybe even the Philippine government. Actually, I think it’s the current administration who paid her because they’ve been very protective of the VFA lately due to the dispute of the Spratly’s and China’s aggressive moves lately. With this case out of the way, they’ll probably retain or do minor modifications to the VFA.

Raped or not raped, Nicole has made a mockery out of herself and the justice system of the Philippines. I’m really disappointed with what happened here. I hope she’s able to live a good life in the US, because if she did sell out, it better be worth it or else she’ll be haunted forever by her conscience.

    This incident just drive other raped victims to hide. Specially those who were victimized by well-known individuals. Then, Nicole made the Filipinas a laughing stock. No wonder some foreign lands treats Filipino women with disrespect.

    i dont know if there’s really sufficient evidence to prove that she was raped or not. either way all i can say is that i am disappointed either way at nicole.

    better that she gives a clearer statement of what actually happened and what she wants to happen.

    if she was raped then she should fight for her rights and every other person who has been abused. not run away and blame it on a judicial system. if she believes that the system is broken then just runs away…

    It is not Nicole, it is the US embassy. I read her affidavit. At stake is the VFA which is vital to US military operation and the life term of a US soldier, in exchange for what – you would have guess it right, visa to the United States of America and pocket money.

    Judge Pozon did not made a mistake. The affidavit did not change the fact that Nicole was not in position to give sexual consent even if she was attracted to Daniel Smith in the bar as described in paragraph 9. She cannot recall anything except the loud music in the van. Technically, it is rape even though she wanted to take off her panties for Daniel Smith which did not happen because she was intoxicated. Her affidavit just wanted to send the message she is willing to take her panties off after the fact but it did not change the issue that she was not able to take her panties off at that time.

    There are so many highly qualified and well financed professionals denied of visa for US study compared to Nicole who is just an accounts receivable clerk and without financial resources.

    But then again, the embassy recognized its interest and what is at stake.

When she was still useful to their cause they made a heroine martyr out of her, took her every utterances as gospel truth and damned everyone else who made the flimsiest of suggestion that things may have happened other than what she said occured that fateful night in Subic. If there is a lesson for us here, Filipinos, it is that we should be more circumspect in our judgment of people, things and events and always to avoid politicizing every issue.
